Fenomena Cerai Gugat di Kabupaten Kuningan: Sebuah Kajian Perubahan Sosial dalam Masyarakat dan Keluarga

Fenomena cerai gugat sebagaimana tercantum dalam penelitian Balitbang dan Diklat Kementerian Agama sejak tahun 2001 hingga tahun 2015 lalu, juga ditemukan di Kabupaten Kuningan, Jawa Barat. Data Peradilan Agama Kabupaten Kuningan menunjukkan, perbandingan cerai gugat: cerai talak, yang mencapai angka ± 70:30 persen,khusus selama rentang Tahun 2012 hingga 2015. Selisih dari perbandingan angka yang muncul dari daerah ini jelas menjadi menarik untuk dikaji,selain karena untuk menguji tren meningkatnya cerai gugat di level nasional, namun juga dalam rangka mendapatkan variasi gambaran atas cerai gugat yang ada di Kabupaten Kuningan. Sebagai daerah dengan lokus geografis berupa perbukitan dan didominasi oleh wilayah pedesaan, serta dalam kondisi ekonomi masyarakat yang masuk dalam daerah wisata berkembang, ditemukannya fenomena tinggi cerai gugat memunculkan pertanyaan besar: sejauhmanakah sebenarnya faktor modernitas dan berbagai turunannya memengaruhi budaya masyarakat di Kabupaten Kuningan. Dan pola cerai gugat seperti apakah yang dapat tergambarkan dari proses cerai gugat (perceraian) yang ada di Kabupaten Kuningan. Sehingga dengan digambarkannya realitas sosiologis yang ada di balik fenomena cerai gugat itu, kelak dapat memberikan nilai kebermanfaatan bagi segenap pihak penentu kebijakan khususnya dalam menentukan metode problem solving atas perkara terkait, maupun secara umum dapat menjadi ibrah bagi segenap pasangan dalam memahami sunnah modernitas yang secara terbuka, kini telah memasuki ruang-ruang privat dan memengaruhi relasi-relasi tradisional keluarga.
Abstract
The phenomenon of contested divorce as stated in Body of Research and Development and Research and Training Center of the Ministry of Religious Affairssince 2001 to 2015 and then, also found in the district of Kuningan, West Java. Data Religious Court District Kuningan showed, comparison contested divorce: talaq divorce reached ± 70:30 percent, specifically over the range of 2012 to 2015. The difference from the comparison figures that emerged from this area obviously be interesting to examine, Not only to the trend test of rising contested divorce at the national level, but also in order to get an overview variation on contested divorce in the district of Kuningan. As the region with the geographical locus of hills and dominated by rural areas, as well as the economic conditions of society are included in the developing tourist area, the discovery of the phenomenon of high-contested divorce raises a big question: to what extent is actually a factor of modernity and various derivatives affect the culture of the people in the district of Kuningan. And what kind of contested divorce patterns can be illustrated by the process of contested divorce (divorce) in the district of Kuningan. Therefore, the representation of sociological realities behind the phenomenon of contested divorce, someday could provide value of usefulness for all the policy makers, especially in determining the method of problem solving of a case related, and generally can be ibrah for all couples in understanding the Sunnah of modernity openly. Where today, it entered private spaces and the influence of traditional family relationships.
