Unregistered marriage is a legal act which gives rise to legal consequences, especially for wife and child born status during the marriage period. Among them is state protection form to married couples in disputes marriage case, whereas according to legislation, unregistered marriage do not have the law power. So also with children protection. Law No. 1 Year 1974 has affirmed the matters registeringterms pertaining to marriage and the rights associated with marriage. This law clearly explains that unregistered marriages in the KUA have no power, especially for rights and obligations in family.
Perkawinan tidak dicatat yang merupakan perbuatan hukum yang menimbulkan akibat-akibat hukum, khususnya bagi istri dan status anak yang dilahirkan selama dalam kurun waktu perkawinan berlangsung. Di antaranya yaitu mengenai bentuk perlindungan negara kepada pasangan suami istri bila terjadi sengketa dalam perkawinan tersebut, padahal menurut perundang-undangan, perkawinan siritidak memiliki kekuatan hukum. Begitu juga dengan perlindungan terhadap anak. UU Nomor 1 Tahun 1974 telah menegaskan ketentuan pencatatan pernikahan serta hak-hak yang terkait dengan Perkawinan. UU ini secara jelas menerangkan bahwa Perkawinan yang tidak tercatat di KUA tidak memiliki kekuatan, terutama terkait hak dan kewajiban dalam keluarga.
