Abstraksi
Seiring dengan tuntutan perkembangan zaman, regulasi tentang pencatatan perkawinan mulai diberlakukan di negeri-negeri muslim mutakhir. Ada yang hanya sekadar menonjolkan aspek formalisme an sich tanpa berpengaruh terhadap substansi hingga pada tataran kriminalisasi yang menjatuhkan sanksi kepada para pelanggarnya, layaknya para pelaku kriminal.Meskipun demikian, dalam kajian fikih klasik, pembahasan tentang pencatatan perkawinan tidak dapat dijumpai dalam berbagai literatur. Pencatatan baru mencuat ketika perkembangan dunia kian kompleks dan problematika kehidupan umat manusia di muka bumi menjadi semakin rumit. Oleh karena itu, ketentuan hukum perkawinan positif yang berlaku di berbagai negeri muslim menyangkut pencatatan perkawinan ini merupakan lompatan pemikiran dalam diskursus hukum keluarga di dunia Islam mutakhir. Dalam arti kata lain, telah terjadi keberanjakan (point of departure) yang tidak hanya mengambil bentuk pengembangan format, namun lebih dari itu, pemberlakuan ketentuan pencatatan perkawinan telah mengantarkan hukum munakahât mencapai performa yang ideal dan patut diapresiasi.
Abstract
Based on the demands of today, the regulation on registration of marriages started to be valid in some Muslim countries. There is only some highlight formalism aspects of an sich which has no effect on the substance at the level of criminalization which penalizing the offenders, like criminals. However, in the study of classical fiqh, the discussion about the registration of marriage can not be found in the literature. New registration appears when the world development more complex and problems of human life on the earth becoming complicated. Therefore, the positive marriage legal provisions applicable in various Muslim countries concerning the registration of marriage which is a leap of thought in the discourse of family law in the Islamic world. In the other words, there is point of departure which is not only take the development format, but more than that, the marriage registration provisions application has led munakahât to achieve ideal performance and should be appreciated.
