Implementasi Maqâshid Al-Syarî’ah dalam Putusan Bahts Al-Masâ’il tentang Perkawinan Beda Agama

Abstrak
Perkawinan dibentuk untuk menciptakan keluarga yang bernuansa harmonis, bahagia dan sejahtera (sakînah mawaddah wa rahmah). Keluarga harmonis, bahagia dan sejahtera merupakan perkawinan yang mencerminkan terwujudnya al-ushûl al-khamsah atau maqâshid al-syarî‘ah. Sedangkan perkawinan beda agama (antara Muslim dengan non-Muslim yang mencakup Musyrik dan Ahl al-Kitâb), merupakan salah satu faktor munculnya berbagai konflik yang akan mengancam keharmonisan, kebahagiaan dan kesejahteraan rumah tangga. Di samping itu, perkawinan beda agama juga disinyalir akan mengancam praktek keagamaan (murtad) bagi salah satu kedua mempelai. Berdasarkan hal tersebut, Bahts al-Masâ’il memutuskan keharaman praktek perkawinan beda agama apapun bentuknya.
Abstract
Marriage formed tocreatea nuanced offamily in harmony, happy and prosperous(sakinah mawaddah wa Rahmah). Harmonious family, happy and prosperous marriage reflects area lization al-Usul al-khamsah or maqasidal-shari'ah. While interfaith marriage (between Muslims and non-Muslims include poly the ists and Ahlal-Kitab), isone of the emergence factors of various conflict that can be a threat of the harmony, happiness and well-being ofthe household. On the other hands, interfaith marriage also allegedly would be a threat forreligious practice (apostasy) forone of the bride and groom. Based on this, Bahtsul-Masa'il decideprohibition of the practice of any form of interfaith marriage
