Pidana Kurungan Bagi Pelanggaran Hukum Perkawinan (Studi Perbandingan antara Malaysia, Pakistan, Tunisia dan Indonesia)

Hukum perkawinan dalam sebuah negara banyak dipengaruhi agama atau madzhab yang dipeluk mayoritas masyarakatnya. Hal ini juga berlaku di Indonesia, Pakistan Malaysia dan Tunisia. Keempatnya memiliki kesamaan dalam hal sumber pengambilan hukum perkawinan dari fikih Islam. Keempatnya juga menerapkan sistem hukum perkawinan yang berbeda satu dengan yang lainnya, sebagai konsekuensi perbedaan sosio kultur masyarakat di masing-masing negara. Walhasil, ketiganya sama-sama menerapkan ketentuan Islam tentang ketentuan perkawinan dengan perbedaan pada beberapa aspek. Termasuk dalam hal pidana bagi pihak-pihak yang melanggar ketentuan perkawinan, keempatnya juga memiliki perbedaan meski sama-sama bersumber dari fikih Islam.
Abstract
Marriage law in a country influenced by many religions or sects which embraced by the majority of society. This case is also happen in Indonesia, Malaysia, Tunisia and Pakistan. Four countries have similarity in terms of making marriage law from Islamic fiqh. The four countries were also introduced a system of marriage laws that difference from one to another, as the consequences of differences in socio-cultural community in each country. As the result, the three countries are equally applying the provisions of Islam on marriage provisions that have differences in some aspects. Including criminal matters for the parties who violate the provisions of the marriage, the four countries also have differences eventhough from the same source of Islamic fiqh.
