Marriage problems for married by accident are often debated. In the fiqh of the four madzhab (Hanafiyah, Malikiyah, Syafi'iyah and Hanabilah) the Moslem scholars differ in their arguments. The Jumhur of the Shafi'iyah cleric who is the most practiced by the Indonesian Islamic community, states that it is not valid until the child is born. KHI is the result of deliberations by Indonesian Moslem scholars to try to accommodate these differences opinion. The existence of article 53 is expected to be the best formulation and bring maslahah to the current people situation and condition, as well as being a guide for the Moslem headman in carrying out duties in the marriage field.
Masalah perkawinan wanita hamil di luar nikah sering menjadi perdebatan. Dalam fiqh empat madzhab (Hanafiyah, Malikiyah, Syafi’iyah dan Hanabilah) ulama-ulama berbeda dalam memberikan argumentasinya. Jumhur ulama syafi’iyah yang merupakan madzhab paling banyak dianut masyarakat islam Indonesia menyatakan tidak sah sampai anak dalam kandungannya lahir. KHI merupakan hasil musyawarah para ulama Indonesia berupaya mengakomodir perbedaan pendapat tersebut. Lahirnya pasal 53 diharapkan menjadi rumusan terbaik dan mendatangkan maslahah pada situasi dan kondisi umat saat ini, sekaligus menjadi pedoman bagi penghulu dalam melaksanakan tugas di bidang perkawinan
