The Islamic inheritance establishing law process as part of positive law in Indonesia is not easy, it experienced various ups and downs since the pre-Islamic da’wah era until now. At least there are three interests that are fighting for a role in this issue, which is common law, colonial law, and Islamic law. This study attempts to examine the legal politics surrounding inheritance law in Indonesia by comparing it to the inheritance law in Saudi Arabia that fully uses Islamic law.
Proses pembentukan hukum waris Islam sebagai bagian dari hukum positif di Indonesia tidaklah mudah, ia mengalami berbagai pasang surut sejak zaman sebelum dakwah Islam hingga sekarang. Setidaknya ada tiga kepentingan yang berebut peran dalam hal ini, yakni hukum adat, hukum warisan kolonial dan hukum Islam. Studi ini mencoba menelaah politik hukum seputar hukum kewarisan di Indonesia dengan membandingkannya pada hukum kewarisan di Arab Saudi yang sepenuhnya menggunakan hukum Islam.
